Terms of Service

AutoSplash ("we", "us", "our") is a car wash discovery platform that shows live estimates, crowd reports, and price visibility, operated by AutoSplash, registered in South Africa. By downloading, accessing, or using the AutoSplash mobile application ("the App"), you ("the User") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the App.

You must be at least 13 years old to use AutoSplash. By using the App you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

Registration

You must create an account to access certain features. You agree to provide accurate, current, and complete information.

Security

You are solely responsible for maintaining the confidentiality of your login credentials. Notify us immediately at support@autosplash.co.za if you suspect unauthorised access.

Termination by You

You may delete your account at any time from within the App settings.

Suspension by Us

We reserve the right to suspend or permanently terminate accounts that:

• Violate these Terms
• Submit false or misleading busyness reports
• Engage in abusive, fraudulent, or illegal behaviour
• Attempt to reverse-engineer or misuse the App

AutoSplash is a discovery tool. We help you find nearby car washes and view estimated busyness and wait times based on user-submitted reports.

We do not:

• Guarantee the accuracy of wait times or busyness levels
• Operate, own, or manage any car wash listed on the platform
• Accept payments or process bookings on behalf of car washes
• Guarantee that any car wash is open, available, or accepting customers at any given time

All contact, booking, and service arrangements are made directly between you and the car wash operator. AutoSplash is not a party to any such arrangement.

You may submit busyness ratings and queue time reports ("Reports"). By submitting a Report you confirm that:

• It reflects your genuine, first-hand experience
• It is accurate to the best of your knowledge
• It does not contain offensive, defamatory, or misleading content

We reserve the right to remove any Report that violates these Terms without notice.

You agree not to:

• Use the App for any unlawful purpose
• Submit false, misleading, or malicious reports
• Attempt to hack, scrape, or disrupt the App or its infrastructure
• Impersonate another user or person
• Use the App to harass, threaten, or harm others
• Attempt to circumvent any security or access control measures

All content, branding, design, code, and data within the App are the property of AutoSplash or its licensors and are protected under South African and international intellectual property law. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

The App integrates with third-party services (e.g. Google Maps for directions, WhatsApp for messaging). Your use of those services is governed by their respective terms and privacy policies. AutoSplash is not responsible for the availability, accuracy, or conduct of third-party services.

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

• Accuracy or reliability of busyness and wait-time data
• Uninterrupted or error-free operation
• Fitness for a particular purpose

Use of the App is entirely at your own risk.

To the maximum extent permitted by South African law, AutoSplash and its directors, employees, and agents shall not be liable for any:

• Indirect, incidental, or consequential loss
• Loss of time, data, revenue, or opportunity
• Damage arising from reliance on user-submitted reports
• Loss arising from a third-party car wash's actions or omissions

Our total liability to you for any claim shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

You agree to indemnify and hold harmless AutoSplash, its directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the App, your submitted Reports, or your violation of these Terms.

We may update these Terms at any time. We will notify you of material changes via the App or email at least 14 days before they take effect. Continued use of the App after that date constitutes acceptance of the updated Terms.

We may terminate or suspend access to the App at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the App ceases immediately.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the South African courts.

We encourage you to contact us first at support@autosplash.co.za to resolve any dispute informally before pursuing legal action.
